Cannabis is not legal federally, and is considered a Schedule I drug. However, states can legalize cannabis for medical or recreational use without the need for federal permission. Unfortunately, this means people can still be federally prosecuted for cannabis, even in states that have legalized it.
The State of New York in 2014 passed the Compassionate Care Act (Assembly Bill 6357) which legalized medical marijuana in the state. Patients must obtain a certification for medical marijuana from a licensed physician, nurse practitioner or physician assistant who is registered with the New York State Medical Marijuana Program.
We recommend not carrying your cannabis when traveling to other states, and keeping to within the confines of the law in terms of the amount you can carry or grow.

Qualifying Conditions
Qualifications for a Registration Certificate in New York State.
A patient must be diagnosed with at least one of the qualifying conditions to received MMJ card:
- Cancer
- HIV or AIDS
- Amyotrophic lateral sclerosis ALS ( aka Lou Gehrig’s Disease)
- Parkinson’s disease
- Multiple sclerosis
- Spinal cord injury with spasticity
- Epilepsy
- Inflammatory bowel disease
- Neuropathy, Radiculopathy, sciatica, pinched nerve, numbness, tingling
- Huntington’s disease
- Post-Traumatic stress disorder P.T.S.D. (Anxiety, Depression, Insomnia, Panic Attacks, etc)
- Chronic pain ( Arthritis, Migraine, Fibromyalgia, Back Pain, Neck Pain, Severe Dysmenorrhea, Endometriosis, Uterine Fibroids, etc)
- Opioid Use Disorder/Substance Use Disorder, you must be enrolled in an Article 32 Treatment program
The severe debilitating or life-threatening condition must also be accompanied by one or more of the following associated or complicating condition: cachexia or wasting syndrome, severe or chronic pain, severe nausea, seizures, or severe or persistent muscle spasms, P.T.S.D or opioid use disorder
The Medical Documentation Necessary for Eligibility
- A copy of their medical records to confirm your diagnosis
- The recommended medical documentation should document your qualifying medical condition. Please include your current medical diagnosis, list of medications, any surgeries, or diagnostic tests confirming your qualifying condition.
- Patient must be a resident of the state of New York
- Provide a copy of your valid NYS Drivers License or Non-Driver ID
